Body
WHEARAS, City Engineering, via the Storm Water Utility, has partnered with MMSD and multiple other groups and municipalities as part of a group known as Yahara Wins for the last three (3) years to complete a pilot of an adaptive management project; and

WHERAS, Yahara Wins was begun by MMSD as a means to allow groups to meet the phosphorous reduction requirements mandated by the Rock River Total Maximum Daily Load (TMDL) enforced by the WDNR and EPA; and

WHERAS, the pilot project has been sufficiently successful that the MMSD Board of Commissioners has authorized proceeding with full implementation of adaptive management as the primary means for MMSD to meet their TMDL phosphorus reductions; and

WHERAS, a full intergovernmental agreement cannot be implemented in a timely manner for the 2016 calendar year; and

WHERAS, all interested parties do not want to lose the momentum that exists on this project by stopping for a year and then restarting in 2017; and

WHERAS, MMSD asked all parties to budget for 2016 an amount equal to that paid in each of the past three (3) years, which City Engineering has done; and

WHERAS, it is the intent of the City of Madison and the Storm Water Utility to participate in a full adaptive management plan; and

WHERAS, the original MOU did not cover the extra year of the pilot project;

NOW, THEREFORE, BE IT RESOVLED THAT:

The Mayor and City Clerk are hereby authorized to execute a MOU with MMSD for continuation of the Adaptive Management Pilot for the 2016 calendar year with the level of funding noted above.
