Title

Authorizing the acceptance of a Public Water Main Easement from Capitol West Towne LLC for an existing water main facility located at 7333 West Towne Way.

Body

WHEREAS, Capitol West Towne LLC, (the “Owner”) is the owner of the property located at 7333 West Towne Way (the “Property”); and

 

WHEREAS, the Property is currently under review by the City of Madison (the “City”) for a minor alteration to a conditional use for building renovations; and

 

WHEREAS, during said City plan review for said minor alteration, the City Water Utility noted that there was no record of a recorded easement for an existing public water main facility located on the Property; and

 

WHEREAS, the City requested that the Owner grant a public water main easement for the existing water main facility, as currently located on the Property; and

 

WHEREAS, the Owner has agreed to grant said public water main easement to the City, at no cost to the City; and

 

WHEREAS, staff from the City of Madison Water Utility and Office of Real Estate Services have reviewed and approve the acceptance of a public water main easement for the existing water main facility, as currently located on the Property.

 

NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Clerk are hereby authorized to accept a Public Water Main Easement from the Capitol West Towne LLC (the “Owner”) for an existing public water main facility located at 7333 West Towne Way, as described on attached Exhibit A and depicted on attached Exhibit B.
