Title

Amending Section 28.071(3)(h)2. of the Madison General Ordinances to eliminate the requirement that rooftop screening of equipment be constructed at least one foot above the height of the equipment.

Body

[DRAFTER'S ANALYSIS:  This ordinance eliminates the requirement that screening of rooftop equipment be constructed at least one foot above the height of the equipment.  Staff believes this requirement confers little benefit and often results in less efficient performance for building systems such as HVAC.

The Common Council of the City of Madison do hereby ordain as follows:

                     Paragraph 2. of Subdivision (h) entitled “Screening of Rooftop Equipment” of Subsection (3) entitled “Design Standards” of Section 28.071 entitled “General Provisions for Downtown and Urban Districts” of the Madison General Ordinances is amended to read as follows:

“2.                     The equipment shall be within an enclosure. This structure shall be set back a distance of one and one-half (1½) times its height from any primary facade fronting a public street. Screens shall be of durable, permanent materials (not including wood) that are compatible with the primary building materials, and shall be constructed to a height of at least one (1) foot above the height of the equipment.”
