Title

Authorizing the Mayor and the City Clerk to execute a Release of Water Main Easement and the grant of a Water Main Easement over a portion of Lot 1 of CSM 9518, located at 4198 Nakoosa Trail.

Body

WHEREAS, Wal-Mart Real Estate Business Trust, being the owner (the “Owner”) of Lot 1 of CSM 9518 at 4198 Nakoosa Trail, wishes to construct an addition to the southeast corner of the Owner’s building (the “Building”) located on said property; and

 

WHEREAS, the proposed addition would result in the encroachment of the Building onto an existing Water Main Easement (“Existing Easement”) as recorded on November 2, 1999 as Document No. 3172893 in the Dane County Register of Deeds Office, said Existing Easement being located behind the Building; and

 

WHEREAS, the Owner desires to have the City of Madison release a portion of the Existing Easement to avoid an encroachment of the Building onto the Existing Easement; and

 

WHEREAS, the Owner desires to grant a new Water Main Easement to replace the released portion of the Existing Easement and has supplied the necessary administrative fee, legal description and exhibits to do so; and

 

WHEREAS, the City Water Utility has reviewed and approved the plans for the relocation of the water main.  

 

NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute a Release of Water Main Easement and the grant of a Water Main Easement over a portion of Lot 1of CSM 9518, located at 4198 Nakoosa Trail, as depicted on attached Exhibits A1 and A2 and legally described on attached Exhibits B1 and B2.
