Amending Section 9.13(7)(h)3. and 9.13(7)(h)6. and creating Section 9.13(7)(h)5.d. of the Madison General Ordinances to clarify that certain vending sites in the Camp Randall High Density Vending Area may include city owned land and deleting an erroneous reference to sidewalk cafes and merchant vending in the High Density Vending Areas.

DRAFTER'S ANALYSIS:  This ordinance amends Sec. 9.13(7) to allow two new vending sites in the Camp Randall High Density Vending Area to be located on city-owned land that is not the street or sidewalk.  Under the Street Vending ordinance, Street Vending occurs only on the street, sidewalk, terrace, or other portions of highway right-of-way.   This amendment will allow two new sites (Kiwanis and Shrine Club sites) that were formerly authorized by a city lease to be converted to street vending sites.  This ordinance also removes unnecessary references to merchant vending and sidewalk cafes from the section on High Density Vending.

This ordinance is a companion to Resolution Legistar ID # 39096 amending the Regulations Governing Vending in the High Density Vending Area.  That resolution converts the Kiwanis and Shrine Club lease sites to vending sites.

The Common Council of the City of Madison do hereby ordain as follows:

                     1.                     Paragraph 3. entitled “Vending Hours” of Subdivision (h) entitled “Miscellaneous Regulations” of Subsection (7) entitled “Regulations and Procedures for Vending in High Density Vending Areas” of Section 9.13 entitled “License For Selling On Public Streets” of the Madison General Ordinances is amended to read as follows:

“3.                     Vending Hours.  No vending shall occur except between the hours of 8:00 a.m. and midnight.  All vending equipment including carts, tables, apparatus and merchandise shall be removed from the street and sidewalks entire vending site during times when vending is prohibited.”

                     2.                     Subparagraph d. of Paragraph 5. entitled “Special Restrictions on Vending in the Camp Randall High Density Vending Area” of Subdivision (h) entitled “Miscellaneous Regulations” of Subsection (7) entitled “Regulations and Procedures for Vending in High Density Vending Areas” of Section 9.13 entitled “License For Selling On Public Streets” of the Madison General Ordinances is created to read as follows:

“d.                     Camp Randall High Density sites U (former Kiwanis lease area) and V (former Shriners lease area) may include city-owned land that is not the street or sidewalk, as indicated on the official map attached to the Regulations Governing Vending in the High Density Vending Area.”

                     3.                     Paragraph 6. entitled “Changes to Vending Site Dimensions” of Subdivision (h) entitled “Miscellaneous Regulations” of Subsection (7) entitled “Regulations and Procedures for Vending in High Density Vending Areas” of Section 9.13 entitled “License For Selling On Public Streets” of the Madison General Ordinances is amended to read as follows:

“(6)                     Changes to Vending Site Dimensions.  The approved dimensions of a sidewalk café under Sec. 9.13(5) or (6), a merchant vending site or other assigned street vending site High Density Vending site are not guaranteed to remain available.  Public construction, street improvements or redesign may result in a vending site being moved, reduced in size or eliminated at any time.  All vending site dimensions (including sidewalk cafes and merchant vending sites) are subject to change if the City makes changes to the construction of the sidewalk and/or streetscape that affect the vending site, including but not limited to the addition or removal of planters, trees, benches, bike racks, bus shelters, sculptures, or any other public amenity.”
