Approving Addendum No. 1 to Kennedy Point Condominiums PUD
Contract No. 2046 (6th AD)
WHEREAS, on December 22, 2005, the developer, Kennedy Point, LLC, hereinafter the "Developer" had entered into a  Contract For the Construction of Public Improvements that will be Accepted by the City of Madison hereinafter the "Contract" with the City of Madison, and;
WHEREAS, Upon the Developer's request, the obligation to complete the requirements as outlined in the Contract shall be transferred to Joseph D. Krupp and Paul Lenhart, equally, and,
WHEREAS, Addendum No. 1 shall require an Assumption of Development Agreement to be executed by Joseph D. Krupp and Paul Lenhart allowing Kennedy Point, LLC to be released from the obligations of the Contract.
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City Clerk are hereby authorized and directed to execute Addendum No. 1 for Kennedy Point Condominiums PUD  to allow for the Developer to transfer liability of Development Agreement No. 2046 from Kennedy Point, LLC to Joseph D. Krupp and Paul Lenhart.
