Title
Approving the preliminary plat and final plat of Village at Autumn Lake Replat generally located on multiple platted lots located along and north of Lien Road on both sides of Felland Road; 17th Ald. Dist.
 
Body
WHEREAS on November 29, 2005, the Common Council adopted Resolution 05-00955 (File ID 02379) approving the final plat of the Village at Autumn Lake subdivision for 285.2 acres of land located along and north of Lien Road on both sides of Felland Road in the City of Madison, Dane County, Wisconsin, said final plat having also been approved by resolutions of the Common Council in August 2004, December 2004 and June 2005; and
 
WHEREAS said final plat was recorded with the Dane County Register of Deeds on March 30, 2006 as Document Number 4175683 in Volume 59-005B of Plats on Pages 20-39; and
 
WHEREAS said final plat dedicated to the public rights of way for various City streets and alleys, and outlots dedicated to the public for various uses including parkland, stormwater management and conveyance, utilities, pedestrian paths, and a (Sun Prairie Area School District) school; and
 
WHEREAS MREC VH Madison Investors, LLC has duly filed a preliminary plat and final plat of Village at Autumn Lake Replat for approval by the Madison Common Council seeking to replat the 285.2 acres of land, including those portions of the previously recorded subdivision dedicated for public use;
 
NOW THEREFORE BE IT RESOLVED that said preliminary plat and final plat be and the same is hereby approved subject to all conditions as required by the reviewing City departments as required by Section 16.23 of the ordinances of the City of Madison and all conditions noted in the Plan Commission files, and which final plat shall be recorded with the Dane County Register of Deeds.
 
BE IT FURTHER RESOLVED that the said plat is hereby added to the official map and the street grades for said plat on file in the City Engineer's Office are hereby approved.
 
BE IT FURTHER RESOLVED that since the public interest requires it, the City Engineer is authorized to begin proceedings to discontinue the rights of way previously dedicated to the public with the plat of Village at Autumn Lake as prescribed by Wis. Stats. Sec. 66.1003(4)(a).
 
BE IT FURTHER RESOLVED that the Planning Division is authorized to reflect the recorded subdivision in the Comprehensive Plan and any applicable neighborhood plans.
 
BE IT FURTHER RESOLVED that the Mayor and City Clerk of the City of Madison are hereby authorized to sign the plat, bond and subdivision contract, subsequent affidavits of corrections, parkland acquisition documents, easement or right-of-way release or procurement documents or any other related document or documents as deemed necessary by the Secretary of the Plan Commission in accordance with the approved plat.
 
BE IT FURTHER RESOLVED that all dedications included in this plat or required as a condition of approval of this plat be and are hereby accepted by the City of Madison.
 
BE IT FURTHER RESOLVED that if found necessary by the City Engineer, in consultation with Planning Division staff, wetland or environmental corridor boundaries need to be altered as a result of this subdivision, the Common Council recognizes and adopts the revised boundaries for any wetland or environmental corridor within the Central Service Area as it relates to this subdivision.
