Fiscal Note
Annual revenues associated with mooring lease agreements have been included in the Parks Division’s Revenue section of the Operating Budget. All future revenues will continue to be budgeted for as a part of the Parks Division’s Operating budget process going forward. There is no anticipated impact upon the tax levy.

To authorize the Parks Division to enter into annual individual Mooring Lease Agreements for the use of buoy or dinghy locations at designated parks, as allowed for by the Board of Park Commissioners.

Body
WHEREAS, the Parks Division has been operating a mooring field program lease agreement in Marshall Park for many years. Under the parks permit program, in exchange for an annual fee and subject to certain conditions, permit holders were granted exclusive use over designated buoy or dinghy locations in a mooring field set up and maintained by the Parks Division. Only watercraft currently and properly registered with the Wisconsin Department of Natural resources are able to participate in the program; and,

WHEREAS, the Parks Division, on the advice of the City Attorney’s Office and Risk Manager, wishes to update its mooring field program forms, lease agreement, and rental charges in order to better detail the relationship between the City and the users, as well as to allow the City to more fully realize the appropriate rental charges associated with this program.

NOW, THEREFORE, BE IT RESOLVED that the Common Council authorizes the continued offering of a mooring field program at Marshall Park, and any other parks as separately authorized by the Board of Park Commissioners; and,

BE IT FURTHER RESOLVED that participation in the program shall be on an annual lease basis, based upon terms and conditions consistent with the “2015 Mooring Lease Agreement-Marshall Park” form attached and incorporated hereto, which form, subject to the approval of the City Attorney and Risk Manager, may be updated from time-to-time; and,
