Fiscal Note
The annual revenue associated with the Pontoon Boat program is approximately $2,500.  The annual revenue associated with the softball and baseball programs is $105,000.  The annual revenue associated with the high school athletics under this agreement is estimated at $20,000.  The annual expenses related to the provision of services at Warner Park Community Recreation Center are approximately $25,000.   Additionally, the expenses required by the City to provide the services covered under this agreement are included in the 2015 Adopted Parks Division Operating Budget.  
 
 
All revenues and expenses are anticipated in the Parks Division and City 2015 Operating Budget.  Revenues from the Pontoon program are accounted for in the Parks Division Operating Budget, as are any revenues from direct reimbursement of expenses (e.g., lighting and service charges).  All other revenue for field usage is accounted for as a part of general fund revenues. There is no impact on the tax levy from this agreement.  Future expenses and revenues will be considered as a part of the annual Parks Division and City Operating budget process.

To authorize the Mayor and City Clerk to enter into a four (4) year Agreement between the City of Madison and the Madison Metropolitan School District, Madison School & Community Recreation for calendar years 2015 through 2018 for school and community recreational programming in Madison Parks.
 
Body
WHEREAS, the City of Madison ("CITY"), Madison Metropolitan School District (MMSD), and the Madison Metropolitan School District's Madison School & Community Recreation ("MSCR") program have had a long and successful relationship in partnering to provide recreational opportunities to the students and residents of Madison; and
 
WHEREAS, previously there have been up to four separate contracts that covered the various aspects of these relationships; and
 
WHEREAS, the CITY, MMSD, and MSCR desire to enter into a single agreement that provides a more efficient and effective contractual relationship; and
 
WHEREAS, since 1996, the City and MSCR have entered into a Pontoon Boat Partnership Agreement that has targeted its boat rental to: (1) people with disabilities; (2) non-profit groups or organizations; (3) non-disabled seniors; (4) low-income groups and individuals; and (5) other members of the general public during limited drop-in hours; and
 
WHEREAS, MSCR is responsible for the promotion, scheduling, funding and management of the Pontoon Boat program with the City's involvement limited to maintaining storage facilities at Tenney Park for MSCR's pontoon boats and equipment, and providing maintenance of the physical facilities at the pontoon boat launch site area within Tenney Park; and
 
WHEREAS, the City has hired the Madison School and Community Recreation (MSCR) section of the Madison Metropolitan School District (MMSD) to provide recreation programs in the Warner Park Community and Recreation Center (WPCRC) since WPCRC's opening; and
 
WHEREAS, the affiliation has been beneficial and the City wishes to continue having MSCR provide programming over the next four years to persons utilizing the WPCRC facility; and
 
WHEREAS, the Madison Metropolitan School District (MMSD) has contracted with the City of Madison Parks Division for several years for the use of Bowman and Goodman Fields and Elver, Olbrich, and Warner Parks for Madison School Community Recreation ("MSCR") adult softball and baseball programs; and,
 
WHEREAS, MSCR wishes to continue this contractual relationship with the City whereby MMSD will pay all maintenance costs and permitting fees as well as provide adequate general liability insurance and a damage deposit for MSCR's non-exclusive use of City parkland
 
WHEREAS, MMSD and the City's Parks Division have an ongoing relationship whereby MMSD pays the City for the use of certain athletic facilities in City parks for MMSD school athletic programs; and
 
WHEREAS, MMSD has requested that the Parks Division continue to provide non-exclusive use of softball diamonds, baseball fields, golf courses, soccer fields, tennis courts, and cross country courses in various City Parks for  MMSD athletic programs for the 2015-2018 calendar years; and
 
WHEREAS, MMSD and the Parks Division have agreed to terms that would be included in this agreement that would allow East High School to obtain priority access to Breese Stevens Field for soccer and football games.
 
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City Clerk are authorized to enter into a four (4) year Agreement between the City of Madison and the Madison Metropolitan School District, Madison School & Community Recreation for calendar years 2015 through 2018 for school and community recreational programming in Madison Parks.
 
BE IT FURTHER RESOLVED, that all such agreements shall be in a form approved by the Risk Manager and the City Attorney.
