Fiscal Note
The 2015 Police Capital Budget Project No. 11, Taser Replacement, includes $165,000 for the purchase of taser equipment and supplies funded by a direct appropriation from the General Fund.  This resolution amends the capital budget to increase the expenditure authority to $183,000 with the difference of $18,000 funded by the sale of the current Tasers.  An additional $31,000 is included in the Police Department segregated training fund for taser training bringing the total amount to $214,000.

Preamble
 
Taser International, Inc. (Taser, hereafter) has supplied the Madison Police Department with electronic control devices, related hardware and equipment, training aids and instructor training since 2002.  The Police Department continues to rely on electronic control devices as a less lethal alternative for the apprehension of resistive subjects.
 
WHEREAS, Taser has been deemed a sole source provider in the past by City Purchasing for the provision of electronic control devices; and,
 
WHEREAS, Taser provides electronic control devices, related hardware and equipment, training aids and instructor training; and,
 
WHEREAS, a Purchase Order under a sole source cannot be created for payment of these invoices without Council action because they exceed $25,000; and,
 
WHEREAS, funding is included in the Police Department training fund for purposes of Taser training ($31,000); and,
 
WHEREAS, funding has been authorized in the 2015 Capital Budget for the purposes of replacing Tasers ($165,000); and,
 
WHEREAS, the budget for this replacement includes revenue from Taser for resale of our current Tasers; and,
 
WHEREAS, a local reputable dealer has offered to purchase our current estimated 190 functioning Tasers at a cost that exceeds the revenue offered by Taser International; and,
 
WHEREAS, the total cost of purchasing Taser equipment and supplies to replace our current inventory and to provide training is $183,000; and,
 
WHEREAS, any additional revenue will be utilized for the purchase of new Tasers and Taser supplies under this sole source agreement.
 
NOW, THEREFORE, BE IT RESOLVED that the Mayor and/or the Purchasing Director, as appropriate, are hereby authorized to execute a sole source purchase agreement with Taser International, Inc. for the purchase of electronic control devices, equipment and training supplies provided to the City Police Department in 2015, in an amount not to exceed $214,000.
 
BE IT FURTHER RESOLVED that the Madison Police Department be authorized to sell current Tasers that will no longer be replaced or maintained by Taser International to a reputable local dealer.
 
BE IT FINALLY RESOLVED that all funds from the sale of the Tasers be used to offset some of the costs to purchase new Tasers.
 
BE IT FINALLY RESOLVED that the 2015 Police Capital Budget will be amended to provide an additional $18,000 for the purchase of Taser equipment and supplies and to provide an offset of $18,000 of revenue from the sale of Tasers toward these costs.
