Authorizing the acceptance of a Quit Claim Deed from Madison Metropolitan Sewerage District dedicating a portion of property at 402 Walter Street for public purposes.
Body
WHEREAS, the Madison Metropolitan Sewerage District ("MMSD"), is the owner of property located at 402 Walter Street commonly known as MMSD Pump Station 6 (the "Pump Station 6 Property"); and
 
WHEREAS, MMSD recently discovered that pursuant to a deed dated July 16, 1943, MMSD holds title to an irregular parcel of land abutting the Pump Station 6 Property, consisting of approximately 3,850 sq. ft. (the "Remnant Parcel"); and
 
WHEREAS, following such discovery, MMSD contacted City Engineering staff and requested that the parcel mapping of the Pump Station 6 Property be corrected to include the Remnant Parcel; and
 
WHEREAS, upon further discussion between MMSD and City Engineering staff it was agreed that it would be in both parties' best interests for MMSD to dedicate the Remnant Parcel to the City as the Remnant Parcel is currently being used for park and right-of-way purposes and serves no practical function for MMSD, Pump Station 6, or any future expansion of Pump Station 6; and
 
WHEREAS, City Parks Division and Engineering Division staff have reviewed and approve of the acceptance of a Quit Claim Deed for the Remnant Parcel, at no cost to the City.
 
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to accept a Quit Claim Deed from MMSD for the Remnant Parcel legally described on attached Exhibit A and depicted on Exhibit B, with such conveyance being for public purposes and at no cost to the City.
