Section 28.074(4)c of the Zoning Code states that any new building or additions over 20,000 square feet or that have more than 4 stories in the Downtown Core zoning district require approval of a conditional use. Section 28.134(3) states that no portion of any building or structure located within one mile of the center of the State Capitol Building shall exceed the elevation of the base of the columns of the Capitol Building or 187.2 feet, City datum, except that church spires, flagpoles, communication towers, elevator penthouses, screened air conditioning equipment on existing buildings and chimneys exceeding such elevation may be approved as a conditional use.
