Accepting Permanent Limited Easements for Public Sanitary and Storm Sewer Purposes across properties located in the Town of Middleton, Wisconsin to serve the future development of the property located at 9803 Old Sauk Road, City of Madison, Wisconsin.
Body
WHEREAS, TRMCKENZIE, INC. ("Owner") is the owner of property located at 9803 Old Sauk Road ("Property"), and requests the granting of seven (7) off-site Permanent Limited Easements for Public Sanitary and Storm Sewer Purposes (collectively, the "Easements") from seven (7) adjacent property owners (collectively, the "Grantors") to the City of Madison to serve the Property; and
 
WHEREAS, the Property is located in the City of Madison ("City"), to the adjacent west of property owned by the Grantors ("Grantor's Property") in the Town of Middleton, as depicted in attached Exhibit B, and lacks connection to public sanitary and storm sewers ("Facilities"); and
 
WHEREAS, City Facilities are located at the terminus of Bear Claw Way to the adjacent east of the Grantor's Property and the Owner is requesting connection to said Facilities across the Grantor's Property to serve the Property; and
 
WHEREAS, the Owner has received verbal agreements from the Grantors to grant Easements, at no cost to the City, for the construction and maintenance of the Facilities; and
 
WHEREAS, recorded Easements are required to memorialize the verbal agreements and legally define the Easements located on the Grantor's Property; and
 
WHEREAS, City of Madison Engineering Division staff has reviewed the Owner's request and approved the acceptance of said Easements by the City.
 
NOW, THEREFORE, BE IT RESOLVED that the City of Madison is hereby authorized to accept from the Grantors, at no cost to the City, seven (7) Permanent Limited Easements for Public Sanitary and Storm Sewer Purposes, as more particularly described and depicted on attached Exhibit A.
