No appropriation is required to adopt this Ordinance and implement its provisions. However, the Planning Division has identified that additional staff resources are required to administer the growing workload associated with Landmarks and Cultural Resource planning efforts. As such, the Division will likely include in a future budget request additional staff resources, subject to State levy limits and Common Council approval.

SUBSTITUTE Creating Chapter 41, Historic Preservation, and repealing and amending Section 33.19 of the Madison General Ordinances to include only the creation of the Landmarks Commission.

DRAFTER'S ANALYSIS: This ordinance constitutes a comprehensive revision of the landmarks ordinance, which was previously contained entirely in Sec. 33.19. Under this proposed ordinance, the substantive regulations pertaining to historic preservation are contained in a newly created Chapter 41, Historic Preservation, while the authority to create the Landmarks Commission will remain in Sec. 33.19.
The revisions contained in this ordinance include extensive structural, organizational and technical edits. Furthermore, this ordinance includes several new policy points and provisions, including 26 new definitions, new sections on demolition by neglect, two new variance types and simplified appeal language. The ordinance also more clearly outlines the processes for designating landmarks and historic districts, obtaining certificates of appropriateness and requesting variances from the standards of the ordinance.
