A resolution to petition the State of Wisconsin Commissioner of Railroads to make a determination to modify an existing crossing of the Wisconsin & Southern Railroad Co. track at North Shore Drive, and a determination of the crossing protection required.
Body
 
WHEREAS, the City of Madison Parks Division in coordination with the Bassett district of Capitol Neighborhoods, Inc. (CNI) have requested the modification of an existing Wisconsin Southern Railroad Co. track crossing at North Shore Drive to provide a sidewalk on the northwest side of the street, connecting Brittingham Park and the Southwest Path; and
 
WHEREAS, the sidewalk on this side of the street is necessary to complete a planned pedestrian connection between the end of the existing sidewalk at Lorrilard Court and the Southwest Path; and
 
WHEREAS, the addition of several new multi-family developments completed or in progress along North Shore Drive have made it necessary to give pedestrians a safe, legal crossing of the railroad at this location.
 
WHEREAS, Wisconsin State Statute requires that the City petition the State of Wisconsin Office of the Commissioner of Railroads to investigate, hold a public hearing and make a determination in these matters regarding public convenience and safety;
 
NOW, THEREFORE BE IT RESOLVED that the Mayor and City clerk are hereby authorized to petition the State of Wisconsin Commissioner of Railroads to make a determination to establish and improve a public pedestrian crossing of the Wisconsin Southern Railroad Co. track and also a determination of the crossing protection required;
 
BE IT FURTHER RESOLVED that the Mayor shall authorize the City Attorney or other City staff as may be necessary to present the City's interests at any hearing before the Commissioner of Railroads.
