The proposed indemnification language in the Project Agreement has been reviewed by the Risk Manager.  While the City's risk exposure is increased by this agreement, the exposure is covered by the City's insurance policy subject to its terms and conditions.  Any impact on costs would not be immediately known.

PREAMBLE
 
The City of Madison is proposing to replace the Milwaukee Street Bridge and Approaches over the East Branch of the Starkweather Creek.  The cost of the design and construction of the bridge and approaches will be funded with 80% federal funds and 20% local funds. All utility work and the west approach work including the work in the intersection of Fair Oaks Avenue will be funded 100% by the City of Madison.  Pursuant to City Ordinances and Policies, the City Engineer advertised for consultant proposals, reviewed the submitted proposals, and recommends the design engineering contract be awarded to MSA Professional Services.
 
The existing structure was built in 1952.  The Bridge is structurally deficient, the deck is in need of replacement and the width is substandard. The proposed project will replace the existing bridge and approaches. Construction is scheduled for 2015.
 
The agreements with the Wisconsin Department of Transportation for cost sharing define the terms under which the City is awarded federal funds and the agreements require that the City indemnify the Wisconsin Department of Transportation. City APM 1-1 requires Common Council approval whenever the City indemnifies another party.
 
NOW THEREFORE BE IT RESOLVED, that the Mayor and City Clerk are hereby authorized to execute agreements with the State of Wisconsin Department of Transportation and MSA Professional Services for the design and construction of the Milwaukee Street Bridge and Approaches over the East Branch of the Starkweather Creek.
 
BE IT FURTHER RESOLVED, that the Common Council approves indemnification of the State of Wisconsin Department of Transportation as set forth in the agreements in order to use federal funds for the Milwaukee Street Bridge.
