Authorizing the execution of an Underground Utility Easement to TDS Telecom Service Corporation, Charter Communications-CCVIII Operating, LLC, and Wisconsin Power and Light Company across a portion of Waldorf Park, located at 1736 Waldorf Boulevard.
Body
WHEREAS, the plat of the First Addition to Mid Town Commons included a platted utility easement located along the southerly line of Lot 87 of said First Addition, adjacent to Waldorf Park, aka Lot 92 Second Addition to Mid Town Commons; said platted utility easement being designed for the location of public utility facilities serving the adjacent developments; and
WHEREAS, TDS Telecom Service Company (“TDS”), Charter Communications-CCVIII Operating, LLC (“Charter”), and Wisconsin Power and Light Company (“WP&L”) inadvertently installed their underground utility facilities outside of said platted utility easement and within Waldorf Park; and
WHEREAS, TDS, Charter, and WP&L (jointly “Grantees”) were contacted about location of their utility facilities and they therefore requested an underground utility easement for their facilities, as located in Waldorf Park at 1736 Waldorf Boulevard; and
WHEREAS, the City of Madison Parks Division and Office of Real Estate Services has reviewed and approve of the granting of said easements to the Grantees, subject to removal or relocation at the request of the City; at the expense of the Grantees.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute Underground Telecommunications Line Easements to TDS Telecom Service Corporation, Charter Communications-CCVIII Operating, LLC, and Wisconsin Power and Light Company across a portion of Waldorf Park, legally described as follows:
