Title
Authorizing the transfer of ownership of Outlot 1 of the BioAg Gateway Replat from the City of Madison to the County of Dane.
Body
WHEREAS, Outlot 2 of the plat of World Dairy Campus was a private street easement owned and managed by the World Dairy Campus Owners Association; and
WHEREAS, pursuant to Resolution Enactment No. RES-13-00304, the City acquired said Outlot 2 from the World Dairy Campus Owners Association; and
WHEREAS, the City, as the owner of Lots 4, 5, 6, 9, 10 11, 12 and Outlot 2 of World Dairy Campus, recently replatted said lots as the BioAg Gateway Replat; and
WHEREAS, the BioAg Gateway Replat was approved by the City of Madison pursuant to Resolution Enactment No. RES-13-00351 and has been recorded with the Dane County Register of Deeds, and
WHEREAS, pursuant to the BioAg Gateway Replat, part of Outlot 2, World Dairy Campus has been replatted as Outlot 1 of the BioAg Gateway Replat (“Outlot 1”); and
WHEREAS, Outlot 1 consists of .2997 acres and is restricted to “private access purposes” pursuant to the BioAg Gateway Replat; and
WHEREAS, the County of Dane is the owner of the property located at 5201 Fen Oak Drive, which parcel is adjacent to and benefits from the private access restriction over Outlot 1; and
WHEREAS, the parcel located at 5303 Fen Oak Drive is also adjacent to Outlot 1, but has direct access to Fen Oak Drive via a private driveway and, therefore, receives no benefit from the private access restriction over Outlot 1; and
WHEREAS, staff from the City of Madison and the County of Dane have previously discussed and agreed that following the recording of the BioAg Gateway Replat, Outlot 1 would be conveyed by the City to the County, at no cost; and
WHEREAS, the Office of Real Estate Services has prepared a Quit Claim Deed to effectuate the transfer of Outlot 1 from the City of Madison to the County of Dane; and
