Amending Sections 11.06(7)(j)5. and 11.06(9)(m) of the Madison General Ordinances to allow pedal-cab drivers to have a valid out-of-state driver's license, and accept gratuities as payment.

DRAFTER'S ANALYSIS: These minor amendments allow a pedal-cab driver to have a valid out-of-state driver's license, and allow pedal-cabs to opt to accept gratuities as payment, rather than have a set rate schedule.

The Common Council of the City of Madison do hereby ordain as follows:
1. Paragraph 5. of Subdivision (j) entitled "Special Rules for Operation of Pedal-cab Vehicles" of Subsection (7) entitled "Operating Requirements" of Section 11.06 entitled "Licensing and Regulating Public Passenger Vehicles, For Hire" of the Madison General Ordinances is amended to read as follows:
"5. No pedal-cab driver shall drive, or be permitted by a pedal-cab operator to drive, a pedal-cab vehicle without a valid Wisconsin driver's license, or a valid driver's license issued by any other state in the United States."
2. Subdivision (m) entitled "Rates for Pedal-Cab Vehicles" of Subsection (9) entitled "Rates of Fares" of Section 11.06 entitled "Licensing and Regulating Public Passenger Vehicles, For Hire" of the Madison General Ordinances is amended to read as follows:
"(m) Rates for Pedal-Cab Vehicles. Rates as set by the operator of a pedal-cab vehicle service shall be set by the hour or fraction thereof or by the block and shall be in the form of a stated amount for the first hour or block and a stated amount for each fraction of an hour or additional block thereafter. Pedal-cabs may opt to accept any tip or gratuity for the service, in lieu of a set rate."
