Accepting a Public Sanitary Sewer Easement from David P. Pientok and Laura J. Tomasko as Co-Trustees of the Pientok-Tomasko Joint Revocable Trust dated December 31, 2008 across property located at 2704 Waunona Way.
Body
WHEREAS, David P. Pientok and Laura J. Tomasko as Co-Trustees of the Pientok-Tomasko Joint Revocable Trust dated December 31, 2008 (the "Owners") are the owners of the property located at 2704 Waunona Way (the "Property"); and
WHEREAS, as a condition of the conditional use permit for the Property, the City Engineering Division is requiring the Owners to grant to the City, at no cost to the City, a public sanitary sewer easement across the Property to accommodate existing public sanitary sewer facilities; and
WHEREAS, the Owners have executed the required easement; and
WHEREAS, the City Engineering Division has reviewed and recommends acceptance of the easement.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Madison authorizes acceptance, at no cost to the City, of a Public Sanitary Sewer Easement from David P. Pientok and Laura J. Tomasko as Co-Trustees of the Pientok-Tomasko Joint Revocable Trust dated December 31, 2008, over the following described property (the "Easement Area"):
A strip of land, five (5) feet in width, located adjacent to and along the Southerly line of the existing easement described in Document Number 861673 of records of the Dane County Register of Deeds, being located within the easterly half of Lot Two (2), Block Two (2), of Raywood Heights in the City of Madison, Dane County, Wisconsin.
