Title
Authorizing the City of Madison to accept ownership from Lake Edge Neighborhood Association of a gathering circle to be located in Lake Edge Park.
Body
WHEREAS, the Lake Edge Neighborhood Association (“the Association”) has requested permission to install a gathering circle (the “Circle”) within Lake Edge Park at 511 Park Court; and

WHEREAS, the location of the Circle is shown on a map attached as Exhibit A and a drawing of the Circle is attached as Exhibit B; and

WHEREAS, the Association will transfer ownership of the Circle to the City after it has been installed, in exchange for the ongoing maintenance and repair of the Circle by the Association; and

WHEREAS, City staff from the Offices of the City Attorney, Engineering, Traffic Engineering, Risk Management, Planning, and Building Inspection have reviewed this Privilege in Streets application and approved it with conditions.

NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Madison authorizes the acceptance of ownership from the Lake Edge Neighborhood Association, of a gathering circle to be located in the Lake Edge Park at 511 Park Court, as shown on the attached Exhibit A and illustrated on Exhibit B; subject to the following conditions:

1. The Association shall be responsible for all costs of installation, maintenance and repair of the Circle.

2. The Association shall locate the Circle within a specific location and use specific construction materials, as approved by the Board of Park Commissioners.

3. The Association shall be responsible for locating all underground utility services in the areas of the Circle and shall contact Diggers Hotline prior to any excavation or construction activities.

4. The Association shall comply with all Madison General Ordinances regarding the construction and installation of the Circle within the park, including any and all applicable City of Madison permits for excavation and installation, incl...
