Authorizing the acceptance of a Permanent Limited Easement for Public Sidewalk Purposes from the Board of Regents University of Wisconsin System over a portion of the property located at 451 S. Pleasant View Road.
Body
WHEREAS, as part of Wisconsin Department of Transportation project No. 5992-00-76 / 5992-01-71, a private contractor incorrectly constructed a sidewalk outside the platted public right-of-way near the southeast corner of Mineral Point Road and S. Pleasant View Road; therefore encroaching into the property owned by the Board of Regents University of Wisconsin System (the "Owner"), located at 451 S. Pleasant View Road; and
 
WHEREAS, the Owner has agreed to grant a Permanent Limited Easement for Public Sidewalk Purposes ("PLE") to the City of Madison (the "City"), at no cost to the City, in lieu of reconstructing the sidewalk in the correct location; and
 
WHEREAS, City Engineering staff recommends the acceptance of the PLE.
 
NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Madison hereby authorizes acceptance from the Board of Regents University of Wisconsin System, at no cost to the City, a Permanent Limited Easement for Public Sidewalk Purposes over a portion of the lands legally described below and depicted on attached Exhibit A.
 
PLE Legal Description:
 
Part of Outlot 7 of University Research Park - Pioneer located in the Northeast One-Quarter (1/4) of the Northwest One-Quarter (1/4) of Section Twenty-Seven (27), Town Seven North (T7N), Range Eight East (R8E), City of Madison, Dane County, Wisconsin, more particularly described as follows:
 
Commencing at the Northwest corner of said Section 27; thence N89°05'48"E along the North line of the Northwest one-quarter (1/4) of said Section 27, 1309.88 feet to the point of intersection with the Northerly elongation of the West line of University Research Park - Pioneer; thence S00°44'44"W, along said elongation line, 75.03 feet to the Northwest corner of said University Research Park - Pioneer; thence along the West line of said plat S00°44'44"W, 251.88 feet; thence S89°15'16"E, 79.71 feet to the East right-of-way line of S. Pleasant View Road and the Point of Beginning; thence N05°12'13"E along said right-of-way line, 87.38 feet to the point of curvature of a 256.00 foot radius curve concave to the southeast; thence continuing along said right-of-way line 63.48 feet along the arc of said curve having a central angle of 14°12'24" and a chord bearing N12°18'25"E, 63.31; thence  S08°11'14"W 150.41 feet to Point of Beginning.
 
PLE acquisition area contains 425.1 square feet or 0.01 acres more or less, as depicted on map Exhibit A.
