Amending Section 3.35(2)(b) of the Madison General Ordinances to extend the Ethics Code exception for elected officials appointed by the City to other boards to also cover employees.

DRAFTER'S ANALYSIS:  The Ethics Code forbids incumbents from taking action that might benefit an organization with which the incumbent is associated, which includes being an officer or being on the board of the organization.  The Code currently excludes elected officials who are appointed and confirmed by the City to such a board, and finds that in such instances they are acting on behalf of the City in serving on the Board.  This amendment extends the exception to city employees who are so appointed, and also covers public boards.

The Common Council of the City of Madison do hereby ordain as follows:
      Subdivision (b) of Subsection (2) entitled "Definitions" of Section 3.35 entitled "Code of Ethics" of the Madison General Ordinances is amended to read as follows:
"(b)      "Associated," when used with reference to an organization, includes any organization in which an individual or a member of her or his immediate family is a director or officer or owns or controls, directly or indirectly, and severally or in the aggregate, at least two percent (2%) of the outstanding equity.  Notwithstanding the foregoing, an elected official or employee who is appointed by the Mayor and or approved by the Council to serve as an officer or board member of a private non-profit organization, or a public committee or board, does so in his/her official capacity as a representative of the City of Madison and, as such, is not "associated" with the private or public organization."
