PREAMBLE
 
The City of Madison has proposed projects to resurface North Livingston Street from East Washington Avenue to East Johnson Street and to construct improvements at the intersection of East Washington Avenue and North Livingston Street and in 2013.  Due to the volume of traffic on East Washington Avenue, and the expedited schedule to complete all work by June 15, 2013, we propose to allow the Contractor to work between the hours of 7:00 PM to 7:00 AM.
 
Madison General Ordinance section 24.08(3) provides the Common Council the ability to allow construction activities outside of the hours of 7:00 AM to 7:00 PM. with the passage of a resolution and a hearing before the Board of Public Works.   
 
The work required to complete the reconstruction projects cannot be accomplished fully between the hours of 7:00 AM and 7:00 PM because:
 
1) Contract specifications will require certain construction activities that disrupt live traffic lanes to take place during off-peak traffic hours in order to minimize the disruption and delay to the traveling public.  The amount of work specified to take place during off-peak traffic hours will require the Contractor to work beyond normal work hours of 7:00 AM to 7:00 PM.
 
2)  The amount of construction to be completed during the projects exceeds standard production rates that a Contractor can reasonably be expected to achieve between the hours of 7 AM to 7 PM, even with extra crews.
 
3) Sawcutting of concrete pavements after the pouring of the concrete must be done about 12 hours after the installation.  The concrete must be hard enough to hold the sawcutting machinery.  The sawcutting must be done soon enough so that the sawcutting occurs before the pavement cracks.  
 
 
The proposed activities beyond the hours of 7:00 AM to 7:00 PM are as follows:

2.      1)      General construction activities between the hours of 7:00 PM and 9:00 PM.  This extends the work day to 7:00 AM to 9:00 PM.  The intent is to provide Contractors with the ability to work two additional hours in the evening for general construction activities.  In addition to the General Contractor and subcontractors, this provision shall apply to utilities and their Contractors doing coordinated work during the project construction.
      2)      Certain utility construction activities and placement of some concrete pavement will require limiting multiple travel lanes on East Washington Avenue and is specified to be completed during off-peak traffic hours.  Extending the work hours will give the Contractor necessary time to complete these operations without affecting peak hours of traffic.  
      3)      The Sawing of Concrete Pavement.  The timing of this activity is dependent on the rate at which the concrete cures.  Sawing will be allowed at any time, however, the contractor should avoid the hours of 10:00 PM to 6:00 AM when possible.  
      3 4)      Private utility companies are required to adjust their facilities to accommodate the reconstruction projects and are installing new facilities in conjunction with the projects.  In order to facilitate the completion of this work in a timely fashion, private utilities will be allowed to engage in general construction activities for 24 hours a day.  General construction actives include splicing operations, operation of portable generators and portable equipment as necessary to perform the work on private utility owned lines, poles and in underground structures.  
 
The Contractor shall make every effort to limit construction to the hours of 7:00 AM to 9:00 PM but shall be allowed to work beyond those hours as defined above or if determined necessary by the Project Engineer with concurrence of the City Engineer or designee.  
 
NOW THEREFORE BE IT RESOLVED, that construction work, with associated noise impacts, between the hours of 7:00 PM and 7:00 AM on N. Livingston St and E Washington Ave are hereby approved in accordance with section 24.08(3) of the Madison General Ordinances, and
 
BE IT FURTHER RESOLVED, that the construction activities outside of the hours of 7:00 AM to 7:00 PM are limited to those activities identified in this resolution and are limited to the hours specified, and
 
BE IT FURTHER RESOLVED, that the approval of that construction work, as provided in this resolution shall expire on July 1, 2013.
