Fiscal Note
Under the terms of the City of Madison/Town of Middleton Cooperative Plan, annexation or attachment of non-commercial properties such as is proposed in this Resolution are exempt from revenue sharing requirements.  Therefore, no appropriation is required in conjunction with this attachment.

Authorizing the Mayor and City Clerk to execute an attachment petition to cause approximately 3.5 acres of City-owned property located on the west side of S. Junction Road (CTH M) south of Mineral Point Road to be attached to the City from the Town of Middleton.
Body
WHEREAS on April 10, 2012, the Common Council adopted Resolution 12-00225 authorizing the acquisition of 3699, 3701, 3703, 3707, 3711, 3713, 3717 and 3723 County Trunk Highway (CTH) M ("the attachment area") for the S. Junction Road/ CTH M reconstruction project; and
 
WHEREAS the parcels comprising the 3.5-acre attachment area have been cleared of improvements in anticipation of the commencement of the highway improvement project; and
 
WHEREAS the City endeavors to annex or attach properties it owns into its corporate limits whenever practical;
 
NOW THEREFORE BE IT RESOLVED that the Mayor and the City Clerk are authorized to execute the attachment petition and all documents related thereto to cause the approximately 3.5 acres to be attached to the City from the Town of Middleton.
 
BE IT FURTHER RESOLVED that the Office of Real Estate Services is authorized to file the attachment petition with the Town of Middleton and City of Madison Clerk according to the procedures for intermediate attachments in Section 12.01 of the 2003 Final City of Madison and Town of Middleton Cooperative Plan.
