DRAFTER'S ANALYSIS:  This ordinance updates incorrect and obsolete references and text as well as increases various fees in various chapters of the Madison General Ordinances.

The Common Council of the City of Madison do hereby ordain as follows:
1.      Subdivision (a) of Subsection (3) entitled "Schedule of Deposits" of Section 1.08 entitled "Issuance of Citations for Violations of Certain Ordinances and Providing a Schedule of Cash Deposits" of the Madison General Ordinances is amended by creating and amending therein the following:

2.      Subdivision (c) of Subsection (1) of Section 7.35 entitled "Septic Tanks, Dry Wells, Tile Fields, Scavengers" of the Madison General Ordinances is amended to read as follows:
"(c)      Applicants for such permit shall furnish a detailed plan of the proposed installation specifying the location of the building served, size and design of septic tank, and location of absorption system in relation to any lot line, shoreline or existing water well. Sufficient percolation tests shall also be furnished by the applicant and, if required by the Director of Public Health for a specific property, sufficient soil borings shall be furnished. The Director of Public Health shall establish compliance with all municipal and state laws, including regulations contained within H 62.20SPS 383-387, of the Rules of the Division of Health, Wisconsin Administrative Code entitled "Sewage Treatment and Disposal Systems", before issuing the permit."
3.      Subdivision (a) of Subsection (1) entitled Plan Examination Required" of Section 18.08 entitled "Plumbing Plan Approval and Review" of the Madison General Ordinances is amended to read as follows:
"(a)      New installations, additions and alterations to drain systems, vent systems, water service systems, and water distribution systems involving 616 or more plumbing fixtures to be installed in public buildings."
4.      Subdivision (b) entitled "Examination Fees" of Subsection (3) entitled "Plan Examination Fees" of Section 18.08 entitled "Plumbing Plan Approval and Review" of the Madison General Ordinances is amended to read as follows:
 
"(b)      Examination Fees. The plan examination fee shall be: determined using the fee schedule found in SPS 302.64, Table 302.64-1.

*NOTE: No additional fee required if submitted with sanitary drain and vent system. Fees are pursuant to Wis. Adm. Code, § SPS 302.64, and may be subject to change annually effective July 1, 1984."
5.      Subdivision (c) entitled "Shoring of Trenches" of Subsection (1) entitled "Turning on Water Service" of Section 18.30 entitled "Sewer and Water Service" of the Madison General Ordinances is hereby repealed.
6.      Subsection (2) entitled "Definitions" of Section 25.03 entitled "Storage of Gunpowder, Propellants and Explosives" of the Madison General Ordinances is amended to read as follows:
"Inhabited Building. The term "building" when used in the American Table of Distances shall mean and include only a building occupied in whole or in part as a habitation for human beings, or any church, schoolhouse, railroad station, airport terminal, mercantile building, garage, factory, or other building where people are accustomed to assemble except operating buildings. (See Wis. Admin. Code § SPS 307.20(17).)"
7.      Subdivision (a) entitled "Group I of Subsection (3) entitled "Fee Schedule" of Section 29.07 entitled "Fee Schedule" of the Madison General Ordinances is amended to read as follows:
"(a)      Group I
The use group shall include new and additions to residential buildings in which families or households live or in which sleeping accommodations are provided for individuals with or without dining facilities excluding hotels, motels, and institutional building
      $.095 per sq. ft.
      + $25.00 for State SealCurrent State Seal Fee as prescribed by DSPS
      Minimum Fee $25.00"
8.      Subdivision (c) of Subsection (11) entitled "Chimneys and Flues" of Section 30.30 entitled "Incinerators" of the Madison General Ordinances is amended to read as follows:
"(c)      All incinerator flue stacks under two hundred sixty (260) square inches shall have clay fire flue liners surrounded with four (4) inches of solid masonry. All flue stacks over two hundred sixty (260) square inches shall be constructed within the requirements of Section Ind. 52.10 of the Wisconsin Administrative Code IBC Section 2113."

Sec. 18.30(1)(c) currently reads as follows:
"(c)      Shoring of Trenches. Whenever there is danger of caving, the sides of the trenches must be supported with adequate sheeting and braces. See Chapter IND 6, Wis. Admin. Code, for shoring requirements."
