Amending Section 24.04(7)(a) of the Madison General Ordinances to better specify where refuse collection vehicles may operate after hours.

DRAFTER'S ANALYSIS: Section 24.04(7)(a) of the Madison General Ordinances prohibits refuse collection vehicles from collecting refuse or operating a trash compactor between the hours of 10:00 p.m. and 6:00 a.m. within 200 feet of any “residential zoned district or any Planned Unit Development Dwelling.” This definition remains somewhat unclear and private haulers have had a history of confusion over this requirement. This amendment seeks to clarify this definition by making it clear that haulers should not operate refuse collection or trash compactors within 200 feet of any property with a residential use. However, by changing this definition, there may be some unintended consequences as certain non-residential conditional uses in residential districts such as schools, churches and parking lots, where this activity was previously subject to this ordinance will no longer be subject thereto.

The Common Council of the City of Madison do hereby ordain as follows:
Subdivision (a) of Subsection (7) entitled “Operation of Refuse Collection Vehicles and Refuse Collection Vehicles’ Compacting Equipment” of Section 24.04 entitled “Prohibition of Noises Disturbing the Public Peace” of the Madison General Ordinances is amended to read as follows:
“(a) No person shall:
1. Collect refuse or permit the collection of refuse with a refuse collection truck between the hours of 10:00 p.m. and 6:00 a.m. within two hundred (200) feet of any residential zoned district or any Planned Unit Development Dwelling lot with a residential use.
2. Operate or permit the operating of the compacting equipment mechanism of any motor vehicle which compacts refuse between the hours of 10:00 p.m. and 6:00 a.m. within t...
