Authorizing the execution of an Underground Telecommunications Line Easement to TDS Telecom Service Corporation across a portion of Engineering Stormwater Utility Parcel 533, located at 8002 Mineral Point Road.
Body
WHEREAS, TDS Telecom Service Company (“TDS”) currently provides telecommunication services to several private properties located along and north of Mineral Point Road and east of Junction Road, by way of underground telecommunication lines located in the Mineral Point Road right-of-way; and

WHEREAS, TDS will be relocating their underground telecommunications facilities along Mineral Point Road due to the proposed reconstruction of Mineral Point and Junction Road in 2013, per City Engineering Project No. 53W0391; and

WHEREAS, TDS has requested an underground telecommunications line easement across a portion of Engineering Stormwater Utility Parcel 533, located at 8002 Mineral Point Road to maintain service to said private properties; and

WHEREAS, City of Madison Engineering Division staff has reviewed and approve of the granting of such easement.

NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute an Underground Telecommunications Line Easement to TDS Telecom Service Corporation across a portion of Engineering Stormwater Parcel 533, legally described as follows:

A strip of land, six (6) feet in width, as depicted on Exhibit A, being located in part of Outlot 2 of Junction Ridge Plat, a recorded plat located in the SE ¼ of the SE ¼, Section 22, Town 7 North, Range 8 East, City of Madison, Dane County, Wisconsin, more particularly described as follows:

Commencing at the Southeast corner of said Section 22; thence on an assumed bearing along the South line of said Southeast Quarter, South 89 degrees 11 minutes 39 seconds West a distance of 589.59 feet; thence North 01 degrees 05 minutes 51 seconds East a dista...
