Fiscal Note
The estimated cost for 2012 is $24,000: $8,000 for set up and training costs and $16,000 for software license fees (four months at $4,000 per month). This has not been budgeted and an appropriation from the contingent reserve may be needed later in the year. The ongoing cost is estimated to be $48,000 annually for software license fees.

DRAFTER'S ANALYSIS: This ordinance is modeled on those adopted in several other cities. It establishes a process for City agencies to post regularly-prepared data to the City website, allowing greater access to the public. Data to be posted are statistical or factual information in a chart or other non-narrative form that are regularly prepared by the agency. Exceptions are provided for information that is confidential or otherwise not subject to release under the public records law. A provision of this ordinance would allow for individuals to “opt out” of the release of any public record that would endanger their life or safety. The project is to be completed by the end of 2013.

The Common Council of the City of Madison do hereby ordain as follows:
1. Subdivision (c) entitled “Public Records Opt Out Policy and Procedures” of Subsection (6) entitled “Time for Compliance and Procedures” of Section 3.70 entitled “Public Records” of the Madison General Ordinances is created to read as follows:
“(c) Public Records Opt-Out Policy and Procedures. The City shall develop a procedure whereby individuals may inform the City that their safety may be endangered by the release of any otherwise available public records and whereby such individuals may request that such records be maintained as confidential records.
