Title
Authorizing the Common Council to accept ownership from Lake Edge Neighborhood Association of a neighborhood entrance sign to be located in Lake Edge Park, near the intersection of Dempsey Road and Park Court.
Body
WHEREAS, the Lake Edge Neighborhood Association has requested permission to install a neighborhood entrance sign within Lake Edge Park, near the intersection of Dempsey Road and Park Court, as shown on Exhibit A; and
 
WHEREAS, the Lake Edge Neighborhood Association has agreed to maintain the neighborhood entrance sign, which is illustrated on Exhibit B; and
 
WHEREAS, the Lake Edge Neighborhood Association will transfer ownership of the neighborhood entrance sign to the City after they have been installed, in exchange for the ongoing maintenance of these items by the Association; and
 
WHEREAS, the location and installation of the neighborhood sign within Lake Edge Park was approved by the Board of Parks Commissioners at their meeting on April 11, 2012; and
 
WHEREAS, City staff from the Offices of the City Attorney, Engineering, Traffic Engineering, Risk Management, Planning, and Building Inspection have reviewed this Privilege in Streets request and approved it with conditions.
 
NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Madison accepts ownership, from the Lake Edge Neighborhood Association, of a neighborhood entrance sign to be located in the Lake Edge Park, near intersection of Dempsey Road and Park Court, as shown on the attached Exhibit A and illustrated on Exhibit B; subject to the following conditions:
 
1.      The Lake Edge Neighborhood Association shall locate the neighborhood entrance sign within a specific area, as approved by the Board of Parks Commissioners.
 
2.      The Lake Edge Neighborhood Association shall be responsible for all costs of installation and maintenance of the neighborhood entrance sign.  
 
3.      The Lake Edge Neighborhood Association shall be responsible for locating all underground utility services in the areas of the sign and shall contact Diggers Hotline prior to any excavation or construction activities.
 
4.      The Lake Edge Neighborhood Association shall comply with all Madison General Ordinances regarding the construction and installation of the signs within public right-of-way, including any and all applicable City of Madison permits for excavation and installation, including a City Engineering Excavation Permit, if applicable.
 
5.      The Lake Edge Neighborhood Association shall agree that the City shall not be held responsible for any damage to the neighborhood entrance sign that may be caused by the City, its employees, contractors, or others.
 
6.      The City may remove the neighborhood entrance sign if not properly maintained, including applicable vehicular vision clearances, by giving the Lake Edge Neighborhood Association sixty (60) days written notice prior to removal.  
 
7.      The City may remove the neighborhood entrance sign if the area occupied by said items is required for transportation or other public purposes, by giving the Lake Edge Neighborhood Association sixty (60) days written notice prior to removal.  Transportation purposes include, without limitation because of enumeration, public alleys, streets, highways, bike paths, sidewalks, and facilities for the development, improvement and use of public mass transportation systems.
