PREAMBLE
 
The State of Wisconsin, Department of Transportation, in cooperation with the City of Madison, is proposing to complete Phase 2 of the reconstruction of the Fish Hatchery Road / Beltline Highway (USH 12) interchange from Greenway Cross to Emil Street.  The project consists generally of raising and widening the bridge deck, removing the NB to WB ramp in the NW quadrant and construction of a new NB to WB on ramp in the WW quadrant.  It includes relocation and reconstruction of Damon Road and construction of water main requested by the City. Work will begin in 2012 and be completed in 2013.  The project will be let and managed by the Wisconsin Department of Transportation.  
 
Madison General Ordinance section 24.08(3) provides the Common Council the ability to allow construction activities outside of the hours of 7:00 AM to 7:00 PM. with the passage of a resolution and a hearing before the Board of Public Works.
 
The reconstruction of the Fish Hatchery Rd interchange cannot be completed between the hours of 7:00 AM and 7:00 PM because:
 
1. Certain activities will disrupt live traffic lanes causing severe disruption and delay if done during peak travel periods, in particular work done on or over the West Beltline Highway.  Night work will be required to avoid traffic backups and excessive disruption to normal traffic patterns.
 
2. Sawcutting of concrete pavements after the pouring of the pavement must be done
about 12 hours after the installation. The concrete must be hard enough to hold the
machinery. The sawcutting must be done soon enough so that the sawcutting
occurs before the pavement cracks.
 
The proposed activities beyond the hours of 7:00 AM to 7:00 PM are as follows:
      
1. General construction activities between the hours of 6:00 AM and 7:00 AM and 7:00 PM and 10:00 PM. This extends the work day to 6:00  7:00 AM to 10:00 PM. The intent is to provide the Contractor with the ability to work extended hours. The design team is very concerned about the ability of the Contractor to complete the first half of work in 2012 prior to the end of the construction season which is on or about December 1. In addition to the General Contractor and subcontractors, this provision shall apply to utilities and their Contractors doing coordinated work during the project construction.
 
2. Bridge construction on the Fish Hatchery Rd bridge over the West Beltline Highway that require lane closures on the West Beltline Highway.  This includes, but is not limited to, removing the existing bridge deck; widening the median bridge pier, pile driving in the median, placing new bridge girders; and repainting existing bridge girders.  This work will be allowed at any time.
 
3.  All work requiring lane closures on the West Beltline Highway.  This includes, but is not limited to, patching the existing pavement, resurfacing the pavement, reconstructing the shoulders, and adjacent westbound exit and entrance ramp construction.  This work will be allowed at any time.
 
4.  Work on the frontage road / Damon Rd in the northwest quadrant.  Closure of the frontage road is required when it is relocated / reconstructed.  This closure will be limited to three weeks to minimize disruption and inconvenience to the public, area businesses, and Metro transit.  Accelerated construction will be required in order to complete work within this time frame.  This work will be allowed at any time.
 
5.  Work on the West Beltline Highway on-ramp in the northwest quadrant.  Closure of this on ramp is required when it is reconstructed.  This closure will be limited to two weeks to minimize disruption and inconvenience to the public.  Accelerated construction will be required in order to complete work within this timeframe.  This work will be allowed at any time.
 
6.  Intersection construction.  Intersections are generally only allowed to be closed on weekends from 10:00 PM Friday to 5:00 AM Monday to minimize traffic disruptions.  Accelerated construction will be required within these areas in order to complete work and reopen the intersection to traffic by Monday morning.  This work will be allowed at any time.
 
7. Concrete paving.  The Contractor shall make every effort to limit this construction to the hours of 7:00 AM to 10:00 PM but shall be allowed to work beyond those hours if determined necessary by the Project Engineer with concurrence of the City Engineer or designee.
 
8. The sawing of concrete pavement. The timing of this activity is dependent on the rate at which the concrete cures. Sawing will be allowed at any time, however the Contractor should avoid the hours of 10:00 PM to 7:00 AM when possible.
 
9. Watermain, storm sewer, private utility and sanitary sewer construction near or under live travel lanes. This is for the construction of laterals and utility crossings. The Contractor shall make every effort to limit this construction to the hours of 7:00 AM to 10:00 PM but shall be allowed to work beyond those hours if determined necessary by the Project Engineer with concurrence of the City Engineer or designee.
 
10. Water services laterals, sanitary sewer laterals and private utility services to businesses where a hardship exists for the business. Construction of service laterals to businesses can create a significant hardship for businesses especially restaurants that must have a constant flow of water. The Contractor shall make every effort to limit this construction to the hours of 7:00 AM to 10:00 PM but shall be allowed to work beyond those hours if determined necessary by the Project Engineer with concurrence of the City Engineer or designee.
 
 
NOW THEREFORE BE IT RESOLVED, that construction work, with associated noise impacts, between the hours of 7:00 PM and 7:00 AM on Fish Hatchery Road interchange are hereby approved in accordance with section 24.08(3) of the Madison General Ordinances, and
 
BE IT FURTHER RESOLVED, that the construction activities outside of the hours of 7:00 AM to 7:00 PM are limited to those activities identified in this resolution and are limited to the hours specified, and
 
BE IT FURTHER RESOLVED, that the approval of that construction work, as provided in this resolution shall expire on November 30, 2013.
