Title: Creating Section 10.09(3) of the Madison General Ordinances to allow for sidewalk, curb and/or gutter repair by property owners and a rebate program for such repairs.

Fiscal Note
It is anticipated that the Sidewalk rebate rate would go from $2.50 to $3.00, and add about $820 per year (for the entire city) based upon typical annual square footage of 1,640 square feet. It is anticipated that the Curb rebate would go from $8.00 to $12.00, and add about $572 per year (for the entire city) based upon typical annual linear footage of 143 linear feet. These rebates are funded out of the Sidewalk Program Capital Budget (810376). No additional appropriation is required.

DRAFTER'S ANALYSIS: This ordinance expressly gives property owners the authority to repair or reconstruct defective public sidewalks, curbs and/or gutters abutting their property, as long as the work is approved by the City Engineer and meets City standards. If the work is performed, the City will reimburse the property owner with a portion of the costs of the work, which amount the City would otherwise eventually be responsible for. By creating this ordinance, property owners will be able to act on defective public property prior to the City’s scheduled repair or replacement projects.
