DRAFTER'S ANALYSIS:  Effective January 1, 2012, the Wisconsin Department of Commerce and the Wisconsin Department of Regulation and Licensing were dissolved and the Wisconsin Department of Safety and Professional Services was created.  This ordinance updates all Department of Commerce references to Department of Safety and Professional Services.  In addition this ordinance updates obsolete references to the Department of Industry, Labor and Human Relations and the Department of Health and Family Services to the Department of Safety and Professional Services.

The Common Council of the City of Madison do hereby ordain as follows:
      1.      Subsection (13) entitled "Adoption by Reference: State and National Codes" of Section 34.01 entitled "General Provisions" of the Madison General Ordinances is amended to read as follows:
"(13)      Adoption by Reference: State and National Codes.
(a)      The codes in the 2009 International Fire Code® and the Wisconsin Administrative Codes that are adopted by reference are the most current edition of the referenced code and any subsequent editions of the referenced codes.
(b)      IFC.  The International Fire Code® - 2009, subject to the modifications specified in this chapter.
(c)      The following Wisconsin Administrative Code Chapters:
CommSPS 305 - Credentials Licenses, Certifications and Registrations
CommSPS 307 - Explosive and Fireworks Materials
CommSPS 310 - Flammable and Combustible Liquids
CommSPS 314 - Fire Prevention
CommSPS 316 - Electrical
CommSPS 318 - Elevators
CommSPS 328 - Smoke Detectors
CommSPS 340 - Gas Systems
CommSPS 343 - Anhydrous Ammonia
Comm 50-64 - Building and Heating, Ventilation and Air Conditioning (built prior to July 1, 2002)

2.      The City Attorney is directed to make corresponding changes to other City ordinances to reflect these updated references, and to otherwise substitute the Department of Safety and Professional Services (DSPS) for the former Department of Commerce, wherever they appear in the Madison General Ordinances.
3.      Subdivision (c) of Subsection (1) entitled "Purpose and Scope of This Code" of Section 30.01 entitled "Administration" is amended to read as follows:
"(c)      Wis. Admin. Code ch. ILHR 23SPS 323 and all subsequent amendments, additions and recodifications thereto are hereby adopted, by reference, and shall apply to all new one- and two-family residential buildings as well as additions and alterations to all existing one- and two-family residential buildings, accessory buildings, and to new portions of moved buildings.  If there are sections of this code that are more restrictive than Wis. Admin. Code ch. ILHR 23SPS 323, then Wis. Admin. Code ch. ILHR 23SPS 323 shall apply.  If there are subjects covered in this code that are not covered in Wis. Admin. Code ch. ILHR 23SPS 323, then this code shall apply."
4.      The City Attorney is directed to make corresponding changes to other City ordinances to reflect these updated references, and to otherwise substitute the Department of Safety and Professional Services (DSPS) for the former Department of Industry, Labor and Human Relations (DILHR), wherever they appear in the Madison General Ordinances.
5.      Subsection (1) of Section 18.09 entitled "Application for Permit to Install Plumbing" of the Madison General Ordinances is amended to read as follows:
"(1)      Any person desiring to do plumbing shall file a permit application with the City of Madison before starting any work, except as provided in Section 18.09(2). The permit application shall be made on forms furnished by the Building Inspection Division of the Department of Planning and Development. All permit applications shall be properly filled out and shall be signed by a person qualified as a licensed plumber registered with the State of Wisconsin Department of Health and Family ServicesSafety and Professional Services. A permit application is not required when minor repairs are made to part of an existing plumbing system. When deemed necessary by the Building Inspection Division of the Department of Planning and Development, the applicant shall furnish drawings illustrating the installation."
