An increase in General Fund revenues of $25,200 associated with the proposed fee changes has been included in the 2012 adopted operating budget, under "General Fund Revenues: Licenses and Permits - Miscellaneous Licenses."

Amending Sec. 38.05(3)(c), creating Sec. 38.05(3)(f)3., amending Secs. 38.06(11)(k) and (12)(e) of the Madison General Ordinances to increase noticing fees and entertainment licenses fees.

DRAFTER'S ANALYSIS: This proposal increases publication noticing fees for new alcohol licenses from $20 to $100 and for renewals from $20 to $40. The Clerk's office is also permitted to bill a retail alcohol license applicant for noticing expenses in excess of $100. The fees for entertainment licenses are increased from $250 to $300.

The Common Council of the City of Madison do hereby ordain as follows:
1. Subdivision (c) entitled "Publication of Alcohol Beverage Application" of Subsection (3) entitled "Application for Licenses" of Section 38.05 entitled "General Licensing Requirements" of the Madison General Ordinances is amended to read as follows:
"(c) Publication of Alcohol Beverage Application. No license to sell alcohol beverages except Class B picnic beer and wine licenses shall be granted until after the expiration of fifteen (15) days from the filing of the application therefor and before any such license may be granted there shall be published in the official paper at least three (3) times successively a notice of such application, containing the name and address of the applicant, the kind of license applied for, and the location of the premises to be licensed. The applicant for license shall deposit a fee of twenty one hundred dollars ($20100), for a new license application or forty dollars ($40.00) for a renewal application for such publication with the City Clerk at the time of filing the application, and the City Clerk shall thereupon cause such publication to be made."
2. Paragraph 3. of Subdivision (f) entitled "Public Hearings Required" of Subsection (3) entitled "Application for Licenses" of Section 38.05 entitled "General Licensing Requirements" of the Madison General Ordinances is created to read as follows:
"3. If the costs of notice under this sub. (f) exceeds one hundred dollars ($100), the City Clerk shall bill the applicant for that portion of the cost that is in excess of one hundred dollars ($100)."
3. Subdivision (k) entitled "Fee" of Subsection (11) entitled "21 + Entertainment License" of Section 38.06 entitled "General Provisions and Hours" of the Madison General Ordinances is amended to read as follows:
"(k) Fee. The annual license fee shall be two three hundred and fifty dollars ($250.00300) and the license shall expire on June 30 following its issuance."
4. Subdivision (e) entitled "Fee" of Subsection (12) entitled "18+ Centers For Visual And Performing Arts" of Section 38.06 entitled "General Provisions and Hours" of the Madison General Ordinances is amended to read as follows:
"(e) Fee. The annual fee for a Center For Visual and Performing Arts license shall be two three hundred and fifty dollars ($250.00300)."
