PREAMBLE
 
The City advertised for the Madison Central Public Library - Remodel and Renovation - General Construction, Contract No. 6437, and received five bids that were opened December 9, 2011.  Three of the five bids were found to be nonresponsive by the Department of Civil Rights for failing to either meet a utilization goal of 20% SBE/DBE or for failing to demonstrate a good faith effort to do so.  
 
In order to avoid the possibility of litigation expenses and delay to the Library project, the City Attorney's Office in consultation with the City Engineer and the City's Department of Civil Rights recommends that the City reject all the bids received and re-bid Contract No. 6437 without using the DBE program and utilize instead the SBE program as set forth in City Ordinances.  
 
NOW, THEREFORE, BE IT RESOLVED, that the Board of Public Works be and is hereby authorized to re-advertise and receive bids for said project using an SBE goal in accordance with existing ordinances; and
 
That the Mayor and City Clerk are hereby authorized to accept dedication of lands and/or easements from any utilities or abutting property owners necessary to construct and complete the Library.  
 
BE IT FURTHER RESOLVED, that the City hereby rejects all five bids received and opened December 9, 2011 for Contract No. 6437.  
 
Be it finally resolved, that in evaluating the SBE compliance by bidders, the City will use a process whereby the information on SBE compliance will be provided and evaluated after the bid opening.
