DRAFTER'S ANALYSIS:  A Merchant Vendor license allows business owners in the State Street Mall and Capitol Concourse Vending area to display merchandise for sale on the sidewalk in front of their business Thursdays through Sundays, and certain holidays.  This amendment would allow merchants with a Merchant Vending license to display their merchandise on the sidewalk whenever the business is open, up to seven days a week.  In addition, this amendment would increase the Merchant Vendor annual license fee from $200 to $250.

The Common Council of the City of Madison do hereby ordain as follows:
      1.      Subparagraph a. of Paragraph 1. entitled "Miscellaneous Restrictions on Merchant Vendors" of Subdivision (j) entitled "Miscellaneous Restrictions on Merchant Vendors and Sidewalk Cafes" of Subsection (6) entitled "Regulations and Procedures for Vending on the State Street Mall/Capitol Concourse" of Section 9.13 entitled "License For Selling On Public Streets" of the Madison General Ordinances is amended to read as follows:
"a.      Merchandise may only be displayed during normal business hours on Thursdays, Fridays, Saturdays, Sundays and the following federal public holidays established under  5 U.S.C. ยง 6103 (New Year's Day, Washington's Birthday, Martin Luther King Jr.'s Birthday, Memorial Day, Independence, Labor Day, Columbus Day, Veteran's Day, Thanksgiving Day, Christmas Day).  Mall/Concourse merchant vendors may display merchandise on other days, if approved by the Vending Oversight Committee (VOC) in conjunction with a special event for which a street use permit has been granted, upon the VOC's determination that such merchant vending will not interfere with the events and will enhance the public use and enjoyment of the Mall/Concourse when the merchant's corresponding place of business is open."
2.      Subsubparagraph iii. entitled "Merchant Vendors" of Subparagraph a. entitled "Annual License" of Paragraph 3. of Subdivision (h) entitled "Mall/Concourse Vending Licenses and Fees" of Subsection (6) entitled "Regulations and Procedures for Vending on the State Street Mall/Capitol Concourse" of Section 9.13 entitled "License For Selling on Public Streets" of the Madison General Ordinances is amended to read as follows:
"iii.      Merchant Vendors:  two hundred fifty dollars ($200250), except as indicated in v. below."
