PREAMBLE
The City of Madison, Dane County, City of Middleton, and Village of Shorewood Hills have proposed a joint project to reconstruct University Avenue from Allen Boulevard to Segoe Road.  The City of Madison is the lead agency for the project and has entered into a design engineering contract with KL Engineering, Inc.    
 
The City of Madison has also approved the University Crossing Development, located at 5101 University Avenue, within the limits of the University Avenue reconstruction project.  As a condition of the Development, the Developer is required to construct public improvements to serve the needs of the Development.  Public improvements that are required to serve the Development that are located within the University Avenue and Whitney Way right of ways are currently not included in the reconstruction plans for University Avenue.  
 
In order to most efficiently construct the public improvements required to serve the University Crossing Development, the improvements should be made part of the University Avenue reconstruction project, with the Developer reimbursing the City for costs associated with the design and construction of those improvements.
 
As a condition of the Development, the Developer has agreed to execute a Developers Agreement with the City of Madison which specifies that all costs incurred by the City associated with the design and construction of public improvements required to serve the Development be reimbursed by the Developer.
 
The City Engineer recommends that additional design services be undertaken by KL Engineering, Inc. to address the need for additional public improvements required by the University Crossing Development.   The additional services include:
      
1.      Revise the plans, specifications and estimates for the University Avenue reconstruction project to include public improvements required to serve the approved University Crossing Development.
 
2.      Collect additional survey data at the entrance to the University Crossing Development site to be used in the design of public improvements required to serve the University Crossing Development.
 
3.      Incorporate into the University Avenue reconstruction plans the design for a half signal intersection at the University Avenue entrance to the University Crossing Development.
 
4.      Revise the Transportation Project Plat for the University Avenue reconstruction project to include right of way changes associated with the University Crossing Development.
 
5.      Complete revisions to the Capacity Analysis Memo for the University Avenue Reconstruction Project documenting the effects of the proposed development on the capacity analysis for the University Avenue reconstruction project.
 
NOW THEREFORE BE IT RESOLVED that the Mayor and City Clerk are hereby authorized to execute an Amendment to the contract between the City of Madison and KL Engineering, Inc., for additional design engineering services for University Avenue from Allen Boulevard to Segoe Road with the costs incurred for the these additional design engineering services being reimbursed to the City by the Developer.
