Fiscal Note
The 2012 Executive Capital Budget of the Department of Planning and Community and Economic Development provides for $5.7 million in funding for the redevelopment of the Capitol Gateway Corridor, which includes the property within the 800 North Block of East Washington Avenue (project. No. 3, "TID 36 - Capitol Gateway Corridor," Account No. 823601).  $80,000 of this funding may provide the required City match to leverage a potential $400,000 in brownfield grant monies.  No additional appropriation is required.

Body
WHEREAS, the United States Environmental Protection Agency ("EPA") has available the following two competitive brownfield grants:
 
1. Assessment Grants to fund the inventory, environmental assessment, and remediation planning for brownfield    properties
 
2. Cleanup Grants to fund the remediation of brownfield properties owned by the City of Madison; and,
 
WHEREAS, the City of Madison had previously identified three target areas of the City where brownfield remediation was desired through its Brownfields Remediation/Elimination & Workforce Development ("BREWD") Program; and,
 
WHEREAS, the City could qualify for an Assessment Grant of up to $400,000, with no required local cost-share, to further inventory, assess, and plan for the remediation of brownfield properties within the three target areas; and,
 
WHEREAS, the City is aware of brownfield cleanup needs within the 800 North Block of E. Washington Avenue currently under ownership of the City; and,
 
WHEREAS, Cleanup Grants can be sought for both the first phase and second phase of development in the 800 North Block of E. Washington Avenue; and,
 
WHEREAS, each of the two phases would be eligible for up to $200,000 of Cleanup Grant funds, with a required 20% local cost-share ($400,000 total EPA with $80,000 total local cost-share); and,
 
WHEREAS, it is necessary that the City complete and file a written application for the aforementioned grants, and if selected for funding, enter into a cooperative agreement with the EPA.
 
NOW THEREFORE BE IT RESOLVED that Common Council authorizes the application and acceptance of a $400,000 EPA Assessment Grant to fund the inventory, environmental assessment, and remediation planning for brownfield properties throughout the City, focusing on the target areas identified through the City's BREWD program; and,
 
BE IT FURTHER RESOLVED that the Common Council authorizes the application and acceptance of two (2) $200,000 EPA Cleanup Grants to fund the environmental cleanup of city-owned property within the 800 North Block of E. Washington Avenue; and,
 
BE IT FURTHER RESOLVED that he Common Council commits to the required 20% local cost-share, equal to $80,000, should $400,000 in EPA Cleanup Grant funds be awarded; and,
 
BE IT FURTHER RESOLVED that the Common Council authorizes the application for an Assessment Grant and Cleanup Grants for the purposes outlined above under the terms and conditions as required by the EPA and the State of Wisconsin and hereby agrees to the understandings and assurances contained in said applications; and,
 
BE IT FINALLY RESOLVED that Mayor and City Clerk are authorized to execute, deliver, accept and record any and all documents and take such other actions as shall be necessary or desirable to accomplish the purpose of this resolution in a form approved by the City Attorney.
