Amending Section 12.325(1) to remove the street-use permit exception to the prohibition against soliciting from the highway.

DRAFTER'S ANALYSIS: This amendment removes an exception to the general ban on persons standing in the highway for purposes of soliciting employment, business, or charitable contributions. The ordinance currently contains an exception if such person has obtained a Street Use Permit under MGO 10.056. That exception was added by ORD-10-00103 in 2010. This amendment would remove that exception and restore the general ban that has been in effect since 12.325 was created in 1992.

The Common Council of the City of Madison do hereby ordain as follows:
Subsection (1) of Section 12.325 entitled "Solicitation on Highway Prohibited" of the Madison General Ordinances is amended by amending therein the following:
(1) No person shall be upon or go upon a highway for the purpose of soliciting employment, business or charitable or other contributions of any kind from the occupant of any vehicle. , unless such person shall have obtained a Street Use Permit pursuant to Sec. 10.056, MGO, or other authorization under these ordinances.
