PREAMBLE
 
This project consists of the installation of trees and shrubs within boulevards and medians throughout the City.  The locations include Raymond Road, Proudfit Street, Olin Avenue, John Nolen Drive, E. Washington Avenue, Regent Street, Shopko Drive, Aberg Avenue, McKee Road, Dorchester Drive and West Broadway.  The installation of landscaping on Raymond Road between Leland Drive and Whitney Way was requested by the Meadowood Neighborhood Association (MNA).  MNA has agreed to maintain this area of landscaping including mulching, trash removal and trimming.  
 
 
1.  That the plans and specifications for Boulevard Landscaping - 2011, be and are hereby approved.
 
2.  That the Board of Public Works be and is hereby authorized to advertise and receive bids for said project.
 
3.  That the Mayor and City Clerk are hereby authorized to accept dedication of lands and/or easements from the Developer/Owner for public improvements located outside of existing public fee title or easement right-of-ways.
 
4. That the Common Council of the City of Madison authorizes the execution of a maintenance agreement with the Meadowood Neighborhood Association, for an area of decorative landscaping to be located in the public right-of-way on Raymond Road between Leland Drive and Whitney Way subject to the following conditions:
 
a.  The City Engineering Division shall install said decorative landscaping, in exchange for on-going maintenance by MNA.   The City is not responsible for any future replacement of the decorative landscaping.
 
b.  MNA's maintenance responsibly shall include mulching, weeding, trash removal, and trimming.
 
c.  MNA may replace the decorative landscaping plantings, if approved by the City Engineer, at no cost to the City.
 
d.  Any chemical agent, insecticide, fertilizer, or other additive that may be used by MNA must meet or exceed all federal, State, and local laws, regulations guidelines, and limitations (including prohibitions) for its use. The City reserves the right to restrict or ban the use of any chemical agent, insecticide, fertilizer or additive on the decorative landscaping.
 
e.  The City may terminate the maintenance agreement and remove the landscaping if not properly maintained, by giving MNA sixty (60) days written notice prior to removal.  
 
f.  The City may terminate the maintenance agreement and remove the decorative landscaping if the area occupied by said landscaping is required for transportation or other public purposes, by giving MNA sixty (60) days written notice prior to removal.  Transportation purposes include, without limitation because of enumeration, public alleys, streets, highways, bike paths, sidewalks, and facilities for the development, improvement and use of public mass transportation systems.
