Fiscal Note
This resolution establishes a community supported (constructed) playground that will be in Wirth Court Park. KaBoom and Goodman Center will enter into a related agreement, and the City will simply accept the donation of the playground and agree to maintain it. The plan is for the City to share in the "community support" payment to KaBoom via Goodman. The total amount would be about $8,500, of which no more than $4,250 would be from the City. Funding is available in the Parks Division's "People for Parks" Capital account (810400). No additional appropriation is required.

Preamble
KaBoom! is a national non-profit organization dedicated to building playgrounds through local participation, and is willing to build a playground in the City of Madison's Wirth Court Park. The Goodman Community Center, a community nonprofit organization, is willing to collaborate with KaBoom! as a Community Partner and Funding Partner in the construction of the new playground in Wirth Court Park.
Whereas, the City of Madison is the property owner of the Project site of the new playground at Wirth Court Park, and
Whereas, the City of Madison Parks Department supports this installation of playground equipment at its Wirth Court Park and will provide maintenance of the playground facility and supervision of its use.
NOW,THEREFORE, BE IT RESOLVED that the City of Madison accepts this donation and approves the installation of the proposed playground equipment at its Wirth Court Park The City of Madison agrees to be the owner of the playground in its entirety, for the lifetime of the playground, including the equipment and/or safety surfacing purchased by KaBoom! and/or the Goodman Community Center.
BE IT FURTHER RESOLVED that the maintenance of the playground faculty and supervision of its use will be the sole responsibility of the City of Madison. The City of Madison shall collaborate with KaBoom! during the project planning process for development of a maintenance program for the playground and shall maintain the playground and the property before and after the build to ensure a safe and attractive playspace. The City of Madison shall accept and maintain engineered wood fiber as playground safety surfacing, meeting standards established by Consumer Product Safety Commission guidelines, for the lifetime of the playground.
