Title
Authorizing the acceptance of a quit claim deed from Madison Gas and Electric Company for the purposes of clearing title to existing University Avenue public right of way.
Body
WHEREAS, the City of Madison Engineering Division has established Project No. 53W0518 - University Avenue (Allen Boulevard to Segoe Rd) (the "Project"); and
 
WHEREAS, Madison Gas and Electric Company ("MGE") is the owner of the property located at 1210 Spring Harbor Drive (the "MGE Parcel"); and
 
WHEREAS, a review of title information indicates that a portion of the existing University Avenue right-of-way adjacent to MGE's Parcel exists by virtue of highway easement only and is not owned in fee by the City; and
 
WHEREAS, MGE has agreed to convey by quit claim deed to the City of Madison, at no cost to the City, any and all interest it has in that part of existing University Avenue abutting the MGE Parcel; and
 
WHEREAS, Engineering Division staff have reviewed the quit claim deed and recommend its acceptance.
 
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Madison authorizes the acceptance of a quit claim deed from Madison Gas and Electric Company, at no cost to the City, for the parcel described below and depicted on attached Exhibit A (the "Subject Parcel").
 
Legal Description of the Subject Parcel
 
Part of Block 2, Spring Harbor and part of the Northwest one-quarter (1/4) of the Southeast one-quarter (1/4) of Section 18, Town 7 North, Range 9 East, City of Madison, Dane County, Wisconsin, more particularly described as follows:
 
Beginning at the intersection of the centerlines of University Avenue and Spring Harbor Drive, thence North 39° West, along the said centerline of University Avenue, 333.1 feet; thence North 51° East, 70 feet, to the Northeast ROW line University Avenue, as presently located; thence South 39° East, along the said Northeast ROW line, 280.76 feet, to the Northwest ROW line of Spring Harbor Drive, as presently located; thence continuing South 39° East, 49.94 feet, to the centerline of Spring Harbor Drive, thence South 49°07' West, along the said centerline of Spring Harbor Drive, 70.04 feet, to the point of beginning.  (Said lands consist of 23,233 square feet and are depicted on attached Exhibit "A")
 
Bearings are based upon the Plat of Survey by Robert M. Long, under the Registered Civil Engineer Philip H. Hintze, dated the 16th of April, 1940, and indexed as H-122 at the Dane County Surveyor's Office.
