Fiscal Note
The Resolution is in response to the recently enacted State biennial budget bill, which has changed the way in which Medicaid-supported transit rides are administered. This resolution allows Metro Transit to efficiently contract for paratransit services with human service agencies, including LogsitiCare Solutions, LLC, with the added convenience of using tickets that the agencies can distribute for individuals that are also eligible for Metro Paratransit service. No significant fiscal impact is anticipated.

PREAMBLE
Metro Transit has established agency fares for qualified human service agencies contracting for social service agency trips for their ADA complementary paratransit eligible clients.   In the interest of having services available within our community, Metro Transit has extended, on a temporary basis, an agency fare arrangement to LogistiCare Solutions, LLC. (LogistiCare). LogistiCare is the contractor for the State of Wisconsin Department of Human Services for non-emergency medical transportation (NEMT) services for eligible individuals.  This action was necessitated by the expedited implementation timeline of July 1, 2011 for statewide Medicaid Transportation Management services on behalf of the State of Wisconsin. This arrangement allows LogistiCare to purchase ADA Complementary Paratransit fare media for agency trips at the Agency Fare Rate and then arrange transportation for the ADA complementary paratransit eligible persons it serves.
 
Metro Transit wishes to formally add this alternative arrangement by which agencies may secure social service agency trips by purchasing social service fare media at the Agency Fare Rate and then arranging transportation for their ADA complementary paratransit eligible clients. Once adopted, Metro Transit will offer this option to qualified human service agencies/ social service agencies, including but not limited to LogistiCare, to purchase agency trips at the Agency Fair Rate for their ADA paratransit eligible clients; these agencies have previously purchased ADA Complementary Paratransit tickets on behalf of individuals.  Any such arrangements will be conditioned on the understanding that such trips cannot impact Metro Transit's capacity to provide its fixed route and ADA complementary paratransit service.
 
Whereas, it is in the City's interests that qualified human service agencies coordinate existing resources to serve our community; and
 
Whereas, the Transit and Parking Commission approved agency fares in its fare tariff on January 12, 2010, and
 
Whereas, qualified human service agencies/social service agencies  have requested an option for their convenience to purchase social service agency fare media for agency trips  and then to arrange agency fare trips for their ADA complementary paratransit eligible clients; and,
 
Whereas, ADA Complementary Paratransit fare media is currently sold by Metro Transit in booklets of 15 tickets with 3 or 4 tickets required to board, dependent upon the time of day; and
 
Whereas, the applicable agency fare rate and paratransit fare rate will be used to determine  the correct  number of ADA Complementary Paratransit fare media tickets required to board for an agency trip (4.5 trips per booklet at the current fare rates), until a one-ticket agency fare ticket system is implemented by Metro Transit;
NOW, THEREFORE, BE IT RESOLVED that the Metro Transit General Manager is authorized to enter into agreements with qualified human service agencies/social service agencies  for social service agency fare media for agency trips for their ADA complementary paratransit eligible clients  purchased at the agency rate established in the Metro Fare Tariff.  Such agreements will authorize the use of ADA Complementary Paratransit fare media as provided herein until a single ticket agency fare ticket system is in place.  Such agreements, which must be approved as to form by the City Attorney and Risk Manager, shall be for an initial term ending with the calendar year and may thereafter be renewed annually, after each calendar year, under the same terms and conditions modified only as to the applicable agency fare, unless terminated by either party.
