Title: Creating new Sec. 8.14(2)(c)4., renumbering and amending current Sec. 8.14(2)(c)4. to 5., creating Sec. 8.14(3)(h) and amending Sec. 1.08(3)(a) of the Madison General Ordinances to create a penalty for drivers who cause damage to a municipal parking facility.

Fiscal Note
There will be a minor increase in General Fund revenues of an estimated $1,500 to $2,500 annually derived from fines, assuming the issuance of 30 to 50 citations per year.

DRAFTER'S ANALYSIS:  This amendment creates a penalty for drivers who cause damage to public property, such as parking gate arms, while leaving parking facilities without paying for parking.

The Common Council of the City of Madison do hereby ordain as follows:
      1.      New Paragraph 4. entitled "Exit From Facility Causing Damage to Public Property" of Subdivision (c) entitled "Rates" of Subsection (2) entitled "Operation" of Section 8.14 entitled "Municipal Parking Facilities" of the Madison General Ordinances is created to read as follows:
"4.       Exit From Facility Causing Damage to Public Property. No person shall cause damage to city property in connection with a violation under paragraph 2. or 3. of this section."
      2.      Current Paragraph 4. entitled "Applicability" of Subdivision (c) entitled "Rates" of Subsection (2) entitled "Operation" of Section 8.14 entitled "Municipal Parking Facilities" of the Madison General Ordinances is renumbered to Paragraph 5 and amended to read as follows:
"45.      Applicability. The registered owner is presumed to be the operator of any vehicle found parked or operating in violation of this subsection.  Except for prohibitions under paragraph 4., Tthe prohibitions in this subsection shall not apply to operators or owners of vehicles who display a permit sticker or carry a card issued by the Parking Utility, or have otherwise received special authorization from the Parking Utility."
      3.      Subdivision (h) of Subsection (3) entitled "Penalty" of Section 8.14 entitled "Municipal Parking Facilities" of the Madison General Ordinances is created to read as follows:
"(h)      Any person violating Sec. 8.14(2)(c)4. of this ordinance shall be subject to a forfeiture of not less than fifty dollars ($50) nor more than five hundred dollars ($500)."
      4.      Subdivision (a) of Subsection (3) entitled "Schedule of Deposits" of Section 1.08 entitled "Issuance of Citations for Violations of Certain Ordinances and Providing a Schedule of Cash Deposits" of the Madison General Ordinances is amended by creating therein the following:

New bail deposits must be approved by the Municipal Judge prior to adoption.  This deposit has been so approved.
