Costs for signage will be borne primarily by the Wisconsin Department of Transportation.  There may be a minor increase in General Fund revenues derived from citation fines.

DRAFTER'S ANALYSIS:  Pursuant to Wis. Stat. § 66.301, the City of Madison and the State of Wisconsin, Department of Transportation, entered into a lease and maintenance agreement (RES-11-00457) which granted the City authority to regulate and enforce parking in the Dutch Mill Park-and-Ride lot. This amendment establishes the authority for the installation of signs which will specify the parking restrictions in this lot, and it establishes the penalties for parking in violation thereof.

The Common Council of the City of Madison do hereby ordain as follows:
      1.      Subsection (18) entitled "Dutch Mill Park-and-Ride" of Section 12.128 entitled "Miscellaneous Restrictions on Parking" of the Madison General Ordinances is created to read as follows:
"(18)       Dutch Mill Park-and-Ride.
(a)      The City Traffic Engineer or designee may regulate parking, stopping and standing in the Dutch Mill Park-and-Ride by the installation of signs which indicate such restrictions.
(b)      No person shall park, stop, or leave standing a vehicle contrary to a sign posted in accordance with (a).
(c)       The City of Madison Police Department is authorized to take any action authorized by Wis. Stat. §§ 349.13(3), 342.40(3), and 341.65(2), in addition to exercising any other lawful authority or duties with respect to the removal of vehicles parked in the Dutch Mill Park-and-Ride lot. This includes without limitation directing the towing of vehicles parked longer than the posted time limits."
2.      Subsection (6) of Section 12.141 entitled "Penalties for Violating Sections 12.122 through 12.140" of the Madison General Ordinances is amended to read as follows:
"(6)      Any person violating any provision of Sections 12.128(2), or (7) or (18) shall be subject to a forfeiture of not less than ten dollars ($10) nor more than two hundred dollars ($200)."
      3.       Subdivision (a) of Subsection (3) entitled "Schedule of Deposits" of Section 1.08 entitled "Issuance of Citations for Violations of Certain Ordinances and Providing a Schedule of Cash Deposits" of the Madison General Ordinances is amended by creating therein the following:

EDITOR'S NOTE:  New bail deposits must be approved by the Municipal Judge prior to adoption.  This deposit has been so approved.
