Title
Authorizing amendments to the "Regulations Governing Vending on the State Street Mall/Capitol Concourse" and "Regulations Governing Vending in High Density Vending Areas" to create a rule that vending equipment may be left unattended during lawful vending hours for not more than 90 minutes.  
Body
WHEREAS, Under sec. 9.13(6) of the Madison General Ordinances, the Vending Oversight Committee (VOC) is empowered to promulgate regulations not inconsistent with Sec. 9.13, governing the sale of goods and personally prepared food on the State Street Mall and Capitol Concourse;  and
WHEREAS, Under sec. 9.13(7) of the Madison General Ordinances, the VOC is also empowered to promulgate regulations not inconsistent with Sec. 9.13, governing the sale of goods and food in High Density Vending Areas;  and
WHEREAS, pursuant to Sec. 9.13 the Common Council must approve the regulations promulgated by the VOC; and
WHEREAS, the regulations are currently published in documents entitled "Regulations Governing Vending on the State Street Mall/Capitol Concourse" and "Regulations Governing Vending in High Density Vending Areas;" and
WHEREAS, at its meetings on February 23 and March 30, 2011, the VOC promulgated amendments to the Regulations to create a rule that vending equipment may be left unattended during lawful vending hours for not more than 90 minutes for all types of Mall/Concourse and High-Density Vendors; and
      WHEREAS, said amendments are set forth in this Resolution using underlines and strike-outs to show changes as appropriate;
NOW, THEREFORE, BE IT RESOLVED, that the Common Council approve the following amendments to the "Regulations Governing Vending on the State Street Mall/Capitol Concourse" and the "Regulations Governing Vending in High Density Vending Areas" recommended by the Vending Oversight Committee:
    
IX.       MISCELLANEOUS REGULATIONS
 
B.      Removal of Carts and Vending Equipment
 
1.  All vending equipment (i.e., carts, tables, apparatus, etc.) shall be removed from the State Street Mall/Capitol Concourse during the hours in which vending is not permitted, as specified in Sec. 9.13(6)(l)1. of the Madison General Ordinances.  No vending equipment shall be left unattended at any time for longer than fifteen minutes except that:
 
2.  Leaving Vending Equipment Unattended.
 
a.   Craft vendors may leave equipment unattended at the vending site for no more than thirty (30) minutes prior to set up and no more than ninety (90) minutes after set up and during lawful vending hours; for no more than thirty (30) minutes;
b.   Food vendors with carts may leave the vending cart site unattended during lawful vending hours in excess of fifteen (15) for a maximum of  ninety (90) minutes. provided that the cart is securely closed.
 
2.3.   Any time vending equipment or carts are left unattended as provided herein, a "CLOSED" sign shall be prominently displayed and shall also indicate the time of departure and the time of return.

V.      VENDING EQUIPMENT
 
J.  High Density Vendors may leave their vending site unattended during lawful vending hours for not more than ninety (90) minutes.
