Title
Authorizing the execution of an Underground Utility Easement and Easement Release to Madison Gas and Electric Company across a portion of Cherokee Marsh North located 6098 North Sherman Avenue.
Body
WHEREAS, Madison Gas and Electric Company ("MG&E") has an existing overhead electric line facility that serves the City of Madison Cherokee Marsh North ("Park") shelter and restroom facilities, at 6098 North Sherman Avenue; and
 
WHEREAS, the City Parks Division requested that MG&E underground a portion of the overhead electric line facility, as part of an upgrade of the electric service to the Park; and
 
WHEREAS, as part of the new underground electric service, MG&E has requested a ten (10) foot wide underground electric easement and release of a portion of the existing easement that will be abandoned ("Easement"), as depicted on Exhibit A; and
 
WHEREAS, the City Parks Division has reviewed and approve of the Easement.
 
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute an Underground Utility Easement and Release of Easement with Madison Gas and Electric for the Easement area described as follows:
 
Two strips of land, ten (10) feet in width, located in the NE1/4 and SE1/4 of Section 13, Town 8 North, Range 9 East, City of Madison and Town of Westport, Dane County, Wisconsin, more particularly described as follows:
 
The right-of-way shall be located five (5) feet on the right side and five (5) on the left side of the centerline of the Grantee's facilities as constructed.  The facilities will located approximately as set forth in the drawing attached hereto as Exhibit "A".
 
This Easement supersedes and is granted in substitution for an unrecorded Line and Pole Extension Easement granted by Fauerbach Brewing Company, date October 20, 1954, Madison Gas and Electric Easement No. 4494.
