Authorizing the Madison Museum of Contemporary Art, as sponsor of the 53rd Annual ART FAIR ON THE SQUARE, EXCLUSIVE RIGHTS to select vendors, salespersons, vending sites and performers for the duration of this special event, 6:00p.m. July 8 to 9:00p.m. July 10, 2011, within the perimeter of the area, defined in the companion resolution, involved in the event.
Body
WHEREAS, Section 9.13(6(k)4. of the Madison General Ordinances authorizes the Common Council to allow the sponsor of a special event to select alternate vendors, salespersons, and vending sites within the perimeter and for the duration of a special event; and

WHEREAS, Section 9.13(6)(k)4. further requires that this authority only be granted upon a separate resolution after some or all vending licenses have already been invalidated within the perimeter of a special event; and

WHEREAS, the Common Council has already approved the invalidation of some or all vending licenses within the perimeter of the ART FAIR ON THE SQUARE in Resolution No. 21829 ; and

WHEREAS, the Madison Museum of Contemporary Art has complied with the procedures set forth in sec. 9.13(6)(k)4. to provide written notice of proposed rules, regulations, fees, and areas affected as well as notice of this hearing to all vendors within the perimeter of the event; and

WHEREAS, the event sponsor shall obtain a Special Event Vending License for all selected vendors, as required by sec. 9.13(2) and (3); and

NOW, THEREFORE, BE IT RESOLVED, that the Madison Museum of Contemporary Art is hereby authorized to select vendors, salespersons and vending sites within its perimeter for the duration of the special event as described in Resolution No. 21829 .

BE IT FURTHER RESOLVED that the vendors and salesperson selected for the special event be limited to vending food, beverages, goods and promotional items (such as T-shirts, posters, souvenirs) which are related to the purpose of the special eve...
