Creating Sec. 10.18(7)(a)8., repealing Sec. 10.18(7)(c), and amending Sec. 10.18(7)(e) of the Madison General Ordinances to require the recycling of directories.

DRAFTER'S ANALYSIS:  This ordinance creates paragraph 10.18(7)(a)8. and amends subsection 10.18(7)(e) to require that recyclable directories, such as commercial phone books provided to residential and business customers of phone companies, be recycled.  Currently, such directories are capable of being recycled and many residents do recycle these directories, but recycling is not required.  This ordinance change specifically imposes this requirement as a means to reduce the disposal of these large recyclable items in the general waste stream.  In addition, this ordinance allows for the Street Superintendent or designee to determine which directories are recyclable, thereby providing flexibility to the Streets Division to include directories whose recyclability is not currently known.  Finally, this ordinance deletes subdivision 10.18(7)(c) regarding curbside newsprint collection as that provision is no longer applicable as newsprint is now covered by the recyclable waste requirements of subdivision 10.18(7)(e).

The Common Council of the City of Madison do hereby ordain as follows:
      1.      Paragraph 8. of Subdivision (a) entitled "Definitions" of Subsection (7) entitled "Separation of Solid Waste Required" of Section 10.18 entitled "Collection of Refuse and Recycling of Solid Waste" of the Madison General Ordinances is created to read as follows:
"8.         Directories shall mean any publication that lists names, addresses, telephone numbers or other similar contact information of people, businesses, members, employees, or other similar categories.  In this Subsection, this definition only applies to those directories capable of being recycled by the City of Madison, as determined by the Street Superintendent or designee."
2.      Subdivision (c) entitled "Newsprint" of Subsection (7) entitled "Separation of Solid Waste Required" of Section 10.18 entitled "Collection of Refuse and Recycling of Solid Waste" of the Madison General Ordinances is hereby repealed.
3.      Subdivision (e) entitled "Recyclable Waste" of Subsection (7) entitled "Separation of Solid Waste Required" of Section 10.18 entitled "Collection of Refuse and Recycling of Solid Waste" of the Madison General Ordinances is amended to read as follows:
"(e)      Recyclable Waste.  Every person disposing of newsprint, yard waste, office paper, directories waste oil, magazines, tires, lead-acid batteries, appliances, barrels and drum containers, corrugated cardboard, ferrous metal cans and containers, aluminum cans, glass bottles and jars, and HDPE and PETE plastic containers in the City of Madison shall separate such items from all other solid waste materials, shall recycle such separated items as provided herein and shall not place such separated items in containers for disposal with other refuse or garbage."
EDITOR'S NOTE:
Sec. 10.18(7)(c) currently reads as follows:
"(c)      Newsprint.  Every person disposing of newsprint or newspapers in the City of Madison shall separate recyclable newsprint from all other solid waste materials and shall place the materials out for collection by the City's collector in accordance with rules, procedures, and schedules specified by the Street Superintendent or such recyclable newsprint may be disposed of by such persons in any other lawful manner."
