Title
Authorizing the execution of an Underground Utility Easement to Wisconsin Department of Transportation Division of Business Management across a portion of a City-owned Stormwater Utility parcel located at 5709 Femrite Drive.
Body
WHEREAS, the Wisconsin Department of Transportation Division of Business Management ("WisDOT") is upgrading fiber optic service for camera monitoring of vehicular traffic on the USH 12/18 - Beltline Highway; and
 
WHEREAS, as part of the upgrade of the traffic monitoring system, WisDOT has requested a ten (10) foot wide underground utility easement ("Easement") across a portion of a City-owned Stormwater Utility parcel located at 5709 Femrite Drive, to access their facilities located along USH 12/18 - Beltline Highway; and
 
WHEREAS, the City Engineering Division has reviewed and approve of the Easement.
 
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute an Underground Utility Easement with Madison Gas and Electric Company for the Easement described as follows:
 
A strip of land, ten (10) feet in width, located in a public greenway, being part of Certified Survey Map No. 1495, Document No. 1406330, in Volume 6, page 201 of Certified Survey Maps as recorded at the Dane County Register of Deeds Office, lying North of a line 110 feet South of the North line of the Southeast ¼ of the Southwest ¼ of Section 23, Town 7 North, Range 10 East, City of Madison, Dane County, Wisconsin, the centerline of said easement strip being more particularly described as follows:
 
The right-of-way shall be located five (5) feet on the right side and five (5) on the left side of the centerline of the Grantee's facilities as constructed.  The facilities will located approximately as set forth in the drawing attached hereto as Exhibit "A".
